This case is listed under the caption "for being mentioned" at the instance of the learned counsel for the applicant.

2. The learned counsel for the applicant submits that the order that was passed on 08.11.2023 in the afternoon was in his absence. It is submitted that the Arbitrator appointed by the aforesaid order, may have conflict of interest against the petitioner as he had appeared against the applicant in the past. Hence, request for a Retired Judge to be appointed as an Arbitrator.

3. In view of the above, Paragraph 4 of the order dated 08.11.2023 shall be substituted as follows:- "Both counsels have consented for appointment of Hon'ble Mr.Justice K.Kannan Former Judge (Retired), Punjab and Haryana High Court, residing at No.3/11, Lakshmi Colony, North Cresent Road, T.Nagar, Chennai - 600 017 (Ph.No.9780008145), as an Arbitrator to resolve the dispute between the parties."
