The petitioner seeks refund of excess Court fee that has been paid. The payment of excess court fee arose because of the wrong calculation made by the learned counsel in calculating 3% of the value of the appeal whereas, the Court fee payable is only 1% in terms of Section 53-A of the Tamil Nadu Court Fees and Suits Valuation (Amendment) Act, 2017. 2.If fee calculated at 1% of the value of the appeal, the Court fee payable is Rs.45,129/-. The appellant has paid a sum of Rs.1,35,386/-. Therefore, they are entitled to refund of a sum of Rs.90,257/-. 3.In view of the above, this petition is ordered as prayed for. (R.S.M., J.)
