1.S.Ramesh Kumar 2.Reliance General Insurance Company Limited Rai's Tower Plot No.2504, II Avenue Anna Nagar, Chennai - 600 040 .. Respondents This case came up for settlement before the Lok Adalat. Both parties are present. M/s.M.Malar, the learned counsel for the appellant and Mr.S.Arun Kumar, the learned counsel for the second respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.1,55,058/- with interest at 7.5% per annum from the date of filing of the petition till the date of deposit with cost. Aggrieved by the award of the Tribunal, the appellant had preferred the present appeal.

2.The claimant is the appellant in this appeal. The entire award amount granted by the Tribunal has been deposited by the Second Respondent Insurance Company. The appellant has preferred the present appeal for enhancement.

3. After due deliberation and consultation, both the parties agreed to enhance the award of the Tribunal by Rs.2,00,000/- in full quit over and above the award passed by the tribunal.

4. The 2nd respondent/Insurance Company is directed to deposit the entire amount arrived at today in full quit, over and above the award passed by the tribunal, less the amount already deposited, if any, within a period of four weeks, from the date of receipt of a copy of this order. On such deposit being made, the claimant / appellant is permitted to withdraw the award amount without insisting on a formal payment out petition. Award is modified accordingly.

5. The Tribunal is directed to transfer the amount through RTGS/NEFT to the parties concerned on proper identification in accordance with the terms of the award, as per the apportionment already made by the 2/4

Tribunal. Consequently, the connected miscellaneous petition, if any, is closed.

6. This Civil Miscellaneous Appeal is disposed of accordingly.
