This petition has been filed to condone the delay of 54 days in filing the Civil Miscellaneous Appeal.

2. Heard the learned counsel for the petitioner. Learned counsel for the respondent has no serious objection in allowing this petition.

3. Considering the submissions made by the learned counsel for the petitioner, this Court is of the view that the delay may be condoned, however, on payment of cost. Accordingly, the delay is condoned on payment of cost of Rs.500/- (Rupees Five Hundred only) by the petitioner to the Madras High Court Legal Aid Services Authority, Chennai, within a period of one week from today. If the cost is paid on or before 19.06.2023 and the affidavit of service is filed, this Petition stands allowed and the registry is directed to number the main appeal. If the cost is not paid and the affidavit of service is not filed on or before 19.06.2023, this C.M.P. stands dismissed without any reference to this Court. (J.N.B.,J.)
