Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the first respondent herein to dispose of the petitioner's appeal dated 22.06.2022 given under the Maintenance and Welfare of Parents and Senior Citizen Act, 2007, within the stipulated time prescribed by this Court.

ORDER

The petitioner is a retired Government School Teacher. Both the petitioner and her husband are senior citizens, and they have no issues out of their wedlock. The petitioner owned a property in Navani Village in Namakkal District, and she settled the said property in favour of her brother Kandasamy, the third respondent, on an assurance given by him that he would take care of the petitioner and her husband. However, the third respondent neglected to maintain them, hence the petitioner made representations under the Maintenance and Welfare of Parents and Senior Citizen Act, 2007, before the authorities concerned.

The petitioner would further submit that she also preferred a writ petition before this Court in W.P.No.7820/2022, and obtained an order of this Court dated 01.04.2022, directing the second respondent to dispose of her application. According to the petitioner, she participated in the proceedings of the second respondent, but apprehending threat from the third respondent, she withdrew that petition and accordingly that petition was dismissed on 21.05.2022. It is alleged that thereafter, she had preferred an appeal before the first respondent on 22.06.2022, and the same is pending on the file of the 2/4

first respondent without being numbered and also no notice was served on the third respondent. Hence, she is before this Court seeking a direction to the first respondent to dispose of her appeal dated 22.06.2022.

3. Heard Mr.A.Anandan, learned Government Advocate appearing for the respondents 1 and 2.

4. This Court now directs the first respondent to expedite the disposal of the appeal filed by the petitioner within a period of eight weeks from the date of receipt of a copy of this order.
