ORDER

This is an application filed under Section 482 Cr.P.C. to call for the records and quash the charge sheet made in P.R.C. No.95/2016 on the file of Chief Judicial Magistrate, Erode (Cr. No.951/2015, Erode North Town Police Station). https://hcservices.ecourts.gov.in/hcservices/

2. After hearing the learned counsel appearing for the petitioner for sometime and when this court is about to dismiss the petition, the learned counsel for the petitioner seeks the indulgence of this Court to grant an order dispensing with the personal appearance of the petitioner before the trial court. He has also made an endorsement in the petition withdrawing this petition.

3. Accordingly, while dismissing the criminal original petition as withdrawn, the personal appearance of the petitioner/Accused before the trial Court is dispensed with, except for receipt of copies, answering the charges, questioning under Section 313 Cr.P.C., passing of judgment, or on any other date as may be required by the trial Court.

4. In the result, the criminal original petition is dismissed as withdrawn. The personal appearance of the petitioner/Accused before the trial Court is dispensed with, as indicated above.

Consequently, the connected criminal miscellaneous petitions are closed.
