ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for a writ of Certiorarified Mandamus challenging the proceedings dated 26.06.2025 wherein petitioner's request for issuance of patta in petitioner's name was refused on the premise that land acquisition proceedings are stated to be pending.

3. It is submitted by the learned counsel for petitioner that land acquisition proceedings was set aside by this Court as early as 20.07.2021 in W.P.Nos.14061 and 14062 of 1994. It is stated that however in the meanwhile patta stood transferred in the name of Tamil Nadu Housing Board, therefore petitioner was compelled to file a representation for transfer of patta in his name, thereafter the impugned order came to be passed. 2/4

4. At the outset, Mr.P.Sathish, learned Additional Government Pleader for respondents on instructions would submit that Tahsildar/ 4th respondent would withdraw the impugned proceedings and conduct a fresh hearing and pass appropriate orders within a time frame to be fixed by this Court.

5. In view thereof, writ petition stands disposed of with a direction to the Tahsildar/ 4th respondent to withdraw the impugned proceedings and conduct fresh hearing and pass appropriate orders in accordance with law insofar as petitioner's request for issuance/ transfer/ restoration of patta is concerned, within a period of 8 weeks from the date of uploading of web copy without waiting for receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law. Consequently, connected miscellaneous petition is closed. No costs.
