PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 1st and 2nd respondents to consider my representation sent on 29.07.2023 and consequently direct 3rd to 5th respondents to issue me an appointment order in my favour that has been pending for over 11 months and direct them to stop harassing me especially based on my caste.

O R D E R
The petitioner herein seeks direction to 1st and 2nd respondents to consider his representation dated 29.07.2023 and consequently direct the respondents 3 to 5 to issue an appointment order in his favour.
2. According to the petitioner, he had undergone one year Junior Saiva Archagar training in Arulmigu Arunachaleswarar Temple, Thiruvannamalai Archagar Training Centre run by 5th respondent temple. It is also stated that he 2/6
is also employed as Teacher in the said Archagar Training Centre run by the 5th respondent temple from 22.08.2022. He further stated that no formal order of appointment has been issued to him till date. In this regard, he submitted a representation on 29.07.2023 to the respondents and the same has not been considered in accordance with law till date.

Mrs.S.Anitha, learned Special Government Pleader takes notice for the 1st respondent and Mr.K.Karthikeyan, learned Government Advocate (HR & CE) takes notice for the respondents 2 to 5, on instructions submit that the representation of the petitioner will be considered and order will be passed by the 5th respondent within a time stipulated by this Court.

Though the petitioner also sought for positive direction to respondents 3 to 5 to issue an appointment order in his favour, such positive direction cannot be issued to the petitioner without verifying his entitlement for appointment. However, the petitioner already submitted a representation on 29.07.2023 to 5th respondent requesting him to issue an appointment order, by taking into consideration his services as teacher from 22.08.2022. 3/6

In these circumstances, this Court without expressing any opinion on the merits of the claim made by the petitioner, is inclined to direct the 5th respondent to consider the representation of the petitioner dated 29.07.2023 and pass final orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
