in W.P.No.9740 of 2018 V.BHARATHIDASAN.J., AND V.PARTHIBAN.J., This miscellaneous petition has been filed seeking permission to amend the prayer clause by substituting the following "For the reasons stated in the accompanying affidavit, it is prayed that the Honourable Court be pleased to issue a Writ of Declaration, declaring that the amendment made to the Tamil Nadu State Judicial Service (Cadre and Recruitment) Rules, 2007 vide GO Ms.No.11, Home (Courts I), 3rd January, 2014 and the consequential notification bearing Notification No.08/2018 dated 09.04.2018 issued by the respondent No.3 - TNPSC, so far as it relates to clause 2(B)(II) are null and void, and thus, render justice"

for the existing prayer clause "For the reasons stated in the accompanying affidavit, it is prayed that the Honourable Court be pleased to issue a Writ of Certiorari, calling for the records in the order bearing Notification

No.08/2018 V.BHARATHIDASAN.J., AND V.PARTHIBAN.J., kmk dated 09.04.2018 issued by respondent No.3 - TNPSC and quashing clause 2(B)(II) of the said Notification dated 09.04.2018 and thus render justice."

2. Heard both sides.

3.Having regard to the reasons set out in the affidavit and the facts and circumstances of the case, this court is inclined to permit the petitioner to amend the prayer.

In the result, this miscellaneous petition is allowed as prayed for.
