This case is taken up for settlement before the Lok Adalat. Both the parties are present. The learned counsel for the petitioner Mr.A.Vinothraj and Mr.M.Murali, learned Government Advocate for the first respondent and 2nd respondent - party in person are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
ORDER
This writ petition is to quash the proceedings in A.P.No.57 of 2021 dated 11.10.2022 passed by the Labour Court ( Special Joint Commissioner of Labour) under Section 33(2)(B) of Industrial Disputes Act, 1947. Now the second respondent, C.Prabhu was dismissed from service. Challenging the same, the present writ petition has been filed.
2. When the matter was referred to Board of Directors of the Metropolitan Transport Corporation, Chennai , the Board has passed the following resolution :- "Resolved to authorize the Managing Director to refer the writ petition in W.P.No.26051 of 2023 before Lok Adalat for amicable settlement to reinstate Thiru.C.Prabhu, Ex2/5
Daily Paid Conductor, Staff No.C55463 of Central Depot as Daily Paid Conductor as fresh entrant from the date of the Lok-Adalat award, as per the Approval Petition order dated 11.10.2022 in A.P.No.57 of 2021 as recommended by the Finance Committee".
A copy of the resolution certified by the Company Secretary and also signed by the learned counsel for the petitioner is filed before the National Lok Adalat.
3. In view of the recommendation, the order passed by the Labour Court (( Special Joint Commissioner of Labour) is set aside. As per Resolution, the petitioner is directed to reinstate the second respondent as fresh entrant from the date of the Lok Adalat Award today i.e. 13.12.2025.

C.Prabhu Party-in-person This Lok Adalat award is passed in terms of the above settlement.
