ORDER

This Contempt Petition has been filed to punish the respondents for willful disobedience of the order passed in W.P.No.4581 of 2021 dated 11.01.2024.

2. The learned counsel for the respondents submitted that the petitioner has already got the benefit on the basis of the proceedings in (Permanent)B.P.(Ch.)No.101 dated 11.06.2008, through which, the similarly placed person has got the benefit of one more increment. He further submitted that as far as (Permanent) B.P.(Ch.) No.102 dated 25.09.2010, the petitioner's name is found in S.No.21. He has already got the increment from 2010 onwards.

3. Had the representation was made when the Writ Petition was taken up, the Writ Petition would have got infructuous. As no proper representation was made on behalf of the respondents, the order appears to have been passed on the presumption that the petitioner has not been given with the benefit at the time when the order was passed.
