Prayer: This Civil Revision Petition is filed under Article 227 of the Constitution of India praying to direct the Hon'ble Subordinate Court at Thiruthuraipoondi to dispose of the O.S.No.138 of 2023 at an early date and pass orders.

ORDER

This petition is filed seeking a direction to direct the Subordinate Court at Thiruthuraipoondi to dispose of the O.S.No.138 of 2023 at an early date.

2. The case of the petitioner is that the Respondents 1 to 5 herein has filed O.S.No.105 of 2013 before the Sub Court, Mannargudi seeking relief of specific performance and for relief of permanent injunction against the petitioner and the Respondents 6 to 11. Thereafter, the said suit was transferred to newly constituted Subordinate Court, Thiruthuraipoondi and numbered as O.S.No.138 of 2023 and the same is pending till date without any progress. Hence, this petition.

3. The learned counsel for the petitioner submitted that the 2/4

Respondents 1 to 5 have filed the suit and they are not interested to prosecute the case and they are seeking adjournments continuously. He further submits that the act of the respondents causes much inconvenience to the petitioner herein. Hence, he prays to allow this petition.

4. The case is of the year 2013 and the same is pending for nearly ten years. Hence, the learned Sub Judge at Thiruthuraipoondi is directed to dispose of the O.S.No.138 of 2023 within a period of three months from the date of receipt of a copy of this Order.

5. With the above directions, this Civil Revision Petition is disposed of. No order as to costs.
