O R D E R
The present criminal original petition has been filed seeking a direction to the learned Judicial Magistrate No.II, Virudhachalam to expedite the trial in C.C.No.59 of 2009 forthwith.
2. It is the case of the petitioner is that the petitioner is the defacto complainant. He has preferred a complaint before the respondent police as against one Panchamurthy and Sivakumar on the allegation of assaulting the petitioner with wooden log and also threatening him with dire consequences and the same was registered in Crime 8 of 2009 and the respondent-police filed a final report before the learned Judicial Magistrate Court No.II, Virudhachalam and the same was taken on file as C.C.No.59 of 2009. The said case is pending for the past 7 years, without any progress. Hence, the petitioner has come up with the present petition. https://hcservices.ecourts.gov.in/hcservices/
3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
4. Considering the facts and circumstances of the case and taking note of the fact that the case is pending since 7 years, without any progress, the learned Judicial Magistrate No.II, Virudhachalam, is directed to expedite the trial and dispose of the same, as early as possible, preferably within a period of six months, from the date of receipt of the copy of this order.
5. Accordingly, this criminal original petition is disposed of.
