O R D E R

The present criminal original petition has been filed to direct the respondent herein to register the complaint of the petitioner dated 14.09.2015.

2. The petitioner has bought a property situated at Thirupanthiyur Village, Sriperumbudur Taluk, Tiruvallur District bearing Survey No.202/15 admeasuring to an extent of 13 cents from the accused namely Parvathiammal, W/o.Vaidyalingam, N.V.Jayakumar, S/o.Vaidyalingam and Sivabooshnammal, D/o.Vaidyalingam vide Sale Deed dated 18.11.1991 in Doc.No.4511/1991, SRO, Sriperumbudur. Thereafter, the said Parvathiammal, N.V.Jayakumar and Sivabooshanammal have sold the very same property to another accused namely A.Kumar, S/o.Arumugam, vide Sale Deed dated 06.12.1999 registered in Doc.No.7008/1999, SRO, Sriperumbudur. The vendors of the petitioner intentionally cheated the petitioner by creating a second sale deed in respect of the very same property sold to https://hcservices.ecourts.gov.in/hcservices/

the petitioner. Therefore, the petitioner lodged a complaint with the Mapedu Police Station. But no action was taken on the said complaint till date. Hence, the petitioner has come forward with the present criminal original petition.

3. I have heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the respondent.

4. When the matter was taken up for consideration, the learned Additional Public Prosecutor submitted as the counter petitioner agreed to cancel the subsequent sale deed, the complaint given by the petitioner was closed. He also produced a copy of the closure report before this Court.

5. In view of the submissions made on either side, as the complaint given by the petitioner has already been closed, nothing survives in this petition and this Criminal Original Petition is closed.
