The learned counsel for the petitioner has made an endorsement to the effect that contesting respondents are respondents 1 & and they are represented by Mr.R.Krishnaswamy. The learned counsel submits that the other respondents 3 to 25 are only formal parties and therefore notice to the respondents 3 to 25 may be dispensed with in the Civil Miscellaneous Petition.

2. In view of the endorsement and the submission made by the learned counsel for the petitioner notice to the respondents 3 to 25 is dispensed with.

3. This petition is filed to condone the delay of 93 days in filing the above Second Appeal.

4. Mr.R.Krishnaswamy, learned counsel appearing for the respondents 1 & 2 submits that he has no serious objection.

5. Considering the averments made in the affidavit filed in support of this petition and being satisfied with the same, the delay of 93 days is condoned. Hence, this petition is ordered as prayed for.
