The Petitioner, who apprehends arrest at the hands of the Respondent police for the offence punishable under Section 420, 294(b), 352 & 502 (i) of IPC in Crime No.22 of 2023 on the file of the Respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the Petitioner by giving false promise and assurance of securing Government job for the Defacto Complainant's Son, received 5 lakh from him on 20.11.2020, but the job was not secured and when the Defacto Complainant approached the Petitioner for getting back the amount, the Petitioner abused him and threatened him with dire consequences. Hence the complaint.

3.Learned counsel for the Petitioner would submit that he has not committed any offence as alleged by the prosecution. The Defacto Complainant's son in law and the Petitioner are friends. The Petitioner introduced the Defacto Complainant to one A.K.Kumarasamy, who is affiliated with a political party and they both seems to have obtained certain Government contracts and the Defacto Complainant invested some money. However, the said A.K.Kumarasamy died and thereby the Defacto Complainant and his son in law, were not able to get back the amount. Due to which, false complaint 1/ 3

was made against this Petitioner. Hence, the learned counsel for the Petitioner seeks anticipatory bail to the Petitioner.

4.Learned Government Advocate (Crl. Side) would submit that the matter is at the stage of preliminary investigation. He vehemently opposed to grant anticipatory bail to the Petitioner.

5.Heard the learned counsel for the Petitioner and the learned Government Advocate (Crl. Side) appearing for the Respondent Police. 6.Taking into consideration the facts and the submissions made by the learned counsel on either sides and the nature and gravity of the offence and fact that the matter is at the stage of preliminary investigation, this Court is not inclined to grant anticipatory bail to the Petitioners. 7.Accordingly, this Criminal Original Petition is dismissed. 05.09.2023 sai 2/ 3
