ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 406 and 496 of IPC in Cr.No.01 of 2021, seeks anticipatory bail.

2. It is the case of the prosecution is that petitioner lodged a complaint before the respondent police stated that petitioner and defacto complainant are husband and wife, living in hosur, at that time petitioner harassed the defacto complainant daily in drunken mode, thereafter she left from the matrimonial home and the petitioner having jewels of the defacto complainant and he was not return the same. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence prays for grant of anticipatory bail.

4.The learned Government Advocate (Crl.Side) submitted that petitioner already filed the petition before this Court in Crl.O.P.No.1204 of 2021, in that petition, petitioner stated that he https://hcservices.ecourts.gov.in/hcservices/

would return the jewels to the defacto complainant and seek permission of this Court to withdraw the petition accordingly he withdrawn, but, he failed to comply the order. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that petitioner is failed to comply the earlier order of this Court, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the petition seeking anticipatory bail is dismissed.
