ORDER

The matter is listed today under the caption 'for being mentioned'. 2.Upon perusal of the Judgment dated 22.07.2025, it is noticed that in paragraph No. 5, the name of the Court has been inadvertently typed as 'XV Court of Small Causes, Chennai'. Accordingly, the Registry is directed to correct the same as 'IV Additional City Civil Court, Chennai' in place of 'XV Court of Small Causes, Chennai' in the Judgment dated 22.07.2025, and issue a fresh copy of the order to the learned counsel

for the parties.

3. Except for the aforesaid correction, the order dated 08.08.2025 shall remain unaltered in all other respects.

S.K.Balasingam ...Respondent Civil Revision Petition filed under Article 227 of Constitution of India, seeking to allow this Civil Revision petition and set aside the Fair order and Decretal order dated 10.07.2025 mad in E.P.No.323 of 2025 in RLTOP.No.402 of 2020 on the file of XV Court of Small Causes at Chennai.

ORDER

The tenant who has suffered an order of eviction in RLTOP proceedings and having preferred an appeal in RLTA.No.52 of 2025, is now before this Court.

2. Learned counsel for the revision petitioner submits that, though the petitioner had moved an application for stay along with the RLTA, no stay was granted initially. However, the said stay application has subsequently been argued and orders have been reserved. However, in the mean time, the execution petition has been instituted by the respondent/landlord in E.P.No.323 of 2025 and delivery has been ordered.

3. Learned counsel for the respondent/landlord would invite attention of the orders passed by this Court in CRP.No.2460 & 2463 of 2025 both dated 09.07.2025, where in similar circumstances, the RLTA was directed to be disposed of on merits and in accordance with law within a period of one month and till such time, EP was directed to be deferred. Hence, the learned counsel submits that, he would be satisfied if similar order is passed in the present revision petition as well.

4. I find that adopting to such a course would protect the interest of the revision petitioner as well as the respondent sufficiently.

5. In view of the above, this Civil Revision petition stands disposed of with a direction to the XV Court of Small Causes, Chennai, to dispose of RLTA.No.52 of 2025 finally on merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order, after hearing the parties. Till such time, no further proceedings shall be undertaken in E.P.No.323 of 2025. No costs. Consequently, the connected miscellaneous petition is closed.
