Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of Writ of Mandamus, directing the respondents to install the Bulk Milk Cooler in the building constructed by the second respondent for that purpose at TSD 584, MGR Nagar Magalir Milk Producers Cooperative Society, Beemanandhal, Thiruvannamalai. The petitioner has filed this petition seeking directions to the second respondent to install the Bulk Milk Cooler in the building constructed by the second respondent for that purpose at TSD 584, MGR Nagar Magalir Milk Producers Co-operative Society, Beemanandhal, Thiruvannamalai.
2. The case of the petitioner is that the petitioner was a President of the above said Society. During his period, he has sent several representations to the respondents to establish a Bulk Milk Coolers, for which, the authorities have sanctioned a sum of Rs.14,61,864/- for the construction of Bulk Cooler under the NADP Scheme. The construction work has been fully completed and machineries also brought by the third respondent. But the Bulk Milk Cooler is not installed till date. Hence, the petitioner filed the present writ petition before this Court seeking appropriate relief.
3. The learned counsel for the petitioner submitted that this Court may direct the authorities to consider the representation made by the petitioner dated 30.11.2021 within the stipulated time as fixed by this Court.
4. The learned Special Government Pleader appearing for the respondents submitted that the representation dated 30.11.2021 made by the petitioner will be considered in accordance with law within the stipulated time as fixed by this Court.
5. Heard both sides and perused the materials available on record.
6.Considering the facts and circumstances of the case and also of the fact that the second respondent has agreed to install the machineries and brought for operation, this Court directs the second respondent to consider the petitioner's representation dated 30.11.2021 and take necessary action on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
7. With the above directions, this writ petition is disposed of. No costs.
