ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 417, 376, 294(b) and 506(i) of IPC in Crime No.10 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant one Divya, who is close relative of the petitioner, the petitioner promised to marry the defacto complainant, but the petitioner and the said defacto complainant fell down love for more than one year and she having intimacy with the petitioner and become pregnant without informing her parents, she got abortion, after that the petitioner refused to marry her. Hence the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the victim girl is with some other boy, there is misunderstanding arose between the family members. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl.Side) submitted that the petitioner is the close relative of the defacto complainant. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of this case, on seeing the entire allegations the girl was conceived and subsequently aborted, if the petitioner released on bail he is absconding, this Court is not inclined to grant anticipatory bail to the petitioner.
