ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to the 3rd respondent is dispensed with.

2. The present writ petition is filed praying for a writ of Mandamus directing the 1st Respondent to dispose of the appeal which was filed by the 3rd Respondent in Na.Ka.No.6691/2024 on the file of 1st Respondent, pertaining to the cancellation of patta granted in favour of the petitioner.

It is submitted that the 3rd respondent has preferred an appeal against issuance of patta in respect of the property comprised in S.F.Nos.54/2B1 and 54/2B2, situated at Theethipalayam Village, Coimbatore South Taluk in the name of the petitioner and that the same is stated to be pending before the 1st respondent. The limited prayer is for disposal of the appeal within a stipulated time frame.

4. At the outset, it is submitted by Mr.A.Selvendran, learned Special Government Pleader for respondents that an enquiry has already been called for 2/4

and in any view they would dispose of the appeal filed by the petitioner after affording the petitioner, 3rd respondent a reasonable opportunity of hearing within a time frame to be fixed by this Court. Agreed to by the learned counsel for petitioner.

Accordingly, the writ petition stands disposed of with a direction to the respondents to dispose of the appeal filed by the petitioner within a period of 16 weeks from the date of receipt of a copy of this order after issuing notice and after affording the petitioner, 3rd respondent and other interested parties a reasonable opportunity of hearing. It is made clear that this Court has not expressed any views with regard to the merits of the appeal and it is open to the concerned respondent to consider the appeal on its own merits and in accordance with law. No costs.
