ORDER

To quash the case in Crime No.203 of 2022 on the file of the 1st respondent, the criminal original petition has been filed.

2.Based on the complaint given by an employee who lost his middle finger in the accident during the course of his employment against the management for the offence under Section 337 IPC for not paying the promised compensation, this criminal original petition being filed. The petitioners were shown as accused persons of the said FIR, since there is prima facie material for investigate the case of wilful negligence on the part of the petitioners under whom the defacto complainant was engaged Skill Mechanical Engineering sustained injuries.

3.Since the matter requires whether the Industry was duly registered under the Employees' State Insurance and other Labour Welfare Statute, therefore, on the basis of the material filed in the quash petition, the criminal complaint cannot be quashed.
