Respondents Prayer :- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents 1 to 3 herein to conduct the survey of the subject lands of the petitioner i.e., Manavari Punjai Land comprised in Thadangam Village survey No.210/3A (77 cents) and 211/2A (23 cents) admeasuring a total extent of 0.40.50 hectares or 1 acre in the Thadangam Revenue Village of the Nallampalli Taluk (then Dharmapuri Taluk) in the Dharmapuri District with the adequate aid of the 4th respondent and fix the boundary stones in the subject lands in light of the guidelines issued in the orders of the case of Asaithambi Vs. The Revenue Divisional Officer in W.P.(MD) No.13465 of 2020 dated 05.10.2020, within the stipulated time prescribed by this Court.

ORDER

This writ petition has been filed for issuance of Writ of Mandamus, directing the respondents 1 to 3 herein to conduct the survey of the subject lands of the petitioner i.e., Manavari Punjai Land comprised in Thadangam Village survey No.210/3A (77 cents) and 211/2A (23 cents) admeasuring to an extent of 0.40.50 hectares or 1 acre situated at Thadangam Revenue Village of the Nallampalli Taluk, Dharmapuri District with the adequate aid of the 4th respondent and fix the boundary stones in the subject lands in light of the guidelines issued in the orders of the case of Asaithambi Vs. The Revenue Divisional Officer in W.P.(MD) No.13465 of 2020 dated 05.10.2020, within the stipulated time prescribed by this Court.

2. Heard, Mr.K.Shankar, learned counsel appearing for the petitioner and Mr.P.Baladhandayutham, learned Special Government Pleader appearing for the respondents 1 to 4.

3. The petitioner filed an application on 22.10.2021 to survey the land and fix the boundary line comprised in survey No.210/3A (77 cents) and 211/2A (23 cents) admeasuring to an extent of 0.40.50 hectares or 1 acre, situated at Thadangam Revenue Village of the Nallampalli Taluk, Dharmapuri District, before the first respondent. The petitioner also paid requisite fee to measure the subject property.

4. Considering the above, the first respondent is directed to survey and measure the property, after issuance of notice to the counter parties and adjacent land owners, if any, after giving them an opportunity of hearing and pass orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

5. With the above direction, the writ petition is disposed of. No costs.
