MARIA CLETE, J This case has been listed under the caption 'For Being Mentioned'. 2.When this matter is taken up for hearing, the learned counsel for the petitioner submits that the evidence stage of the respondent herein in F.C.O.P.No.9 of 2023 has been completed. However in paragraph nos.5 & 7 of the order dated 06.01.2026 passed by this court, it has been only observed as the evidence stage has already been completed. 3.Accordingly, Paragraph Nos. 5 and 7 of the order are modified as follows;
"5.The Learned counsel for the respondent submits that F.C.O.P.No.9 of 2023 is at an advanced stage and that the evidence stage of the respondent herein has already been completed, and therefore, transferring the said proceeding at this stage would cause delay and prejudice, and the same may not be warranted." "7.This Court has considered the above submissions. The power under Section 24 CPC is to be exercised to secure the ends of justice and to facilitate effective adjudication. Considering that F.C.O.P.No.9 of 2023 is stated to have completed the evidence stage of the respondent herein, and to avoid inconsistent judgment, this Court is of the view that 1 / 2 https://www.mhc.tn.gov.in/judis
Tr.C.M.P.No.820 of 2025 DR. A.D. MARIA CLETE, J ay the ends of justice would be met by transferring H.M.O.P.No.12 of 2025 to the Family Court, Vellore."
3.Registry is directed to carry out the aforesaid amendments and issue fresh order copy.
