CORAM:
THE HON'BLE MRS. JUSTICE T.V.THAMILSELVI P.Loganayaki ...
Petitioner -VsC.Jaiganesh ... Respondent Prayer: Civil Revision Petition is filed under Article 227 of the Constitution of India, praying to direct the learned Subordinate Judge, Panruti to dispose the O.P.No.32 of 2021 as expeditiously as possible, preferably by fixing a time frame by allowing the above Civil Revisioin Petition.
For Petitioner :
Mr.P.Selvaraj 1/4
ORDER
The Revision Petitioner wife herein filed a petition for divorce in H.M.O.P.No.32 of 2021 before the Sub-Court, Panruti, but all these years, the matter was adjourned and the case is pending without any progress.
2. Since the relief claimed by the Revision Petitioner only seeking a direction for a speedy disposal, the notice to the respondent is dispensed with.
3. E-court status perused. On perusal of e-court status, it reveals that the matter was adjourned from 2021 onwards and the process was not yet returned, await notice. But, many number of times, for the same reason, the trial judge adjourned the matter without application of mind. If at all, notice was not returned, the trial judge ought to have taken steps to serve notice through private notice or else through paper publication. Inspite of that, the matter is adjourned for await service, which would clearly shows the non-application of the mind of trial judge. Therefore, the trial judge is directed to issue notice to the respondent as per manner known to law either paper publication or else through private notice within a period of 2/4
four weeks from the date of receipt of copy of this order and proceed with the matter according to law. Accordingly, this Civil Revision Petition is disposed of. No costs.
