ORDER
This petition is filed praying to direct the second respondent to register an FIR based on the petitioner's complaint, dated 29.11.2022 in accordance with the order passed by the District Munsif-cum-Judicial Magistrate, Sholinganallur in C.M.P.No.700 of 2024, dated 21.11.2024 and to commence and carry out a fair investigation into the alleged cognizable offences, as mandated by the Bharatiya Nagarik Suraksha Sanhita, 2023.

Though the learned counsel for the petitioner submitted that, initially, the petitioner filed a complaint before the respondent-Police, the respondent failed to register a case, and therefore, he approached the learned Magistrate, Sholinganallur invoking Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and the learned Magistrate, after considering the petition filed by the petitioner, gave a direction on 21.11.2024 to register the case and investigate the matter. But even after the direction given by the Magistrate also, the respondent-Police had not registered the case and thereore, the petitioner is constrained to approach this Court by way of this petition.
3. Learned Government Advocate (Criminal Side) appearing for the 2 / 4
respondents submitted that on 19.07.2025, the FIR was registered.

It is seen from the records that the order was passed on 21.11.2024 and the respondent-Police was also a party to those proceedings, but they have not initially registered the FIR and only after 7 months, the FIR had been registered, and therefore, the respondent-Police is directed to expedite the investigation and file charge-sheet before the Court within a period of three months.
