Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent to remove the name of the petitioner in History Sheet H.S.No.374 of 2005 on the file of the Inspector of Police, Annamalai Nagar Police Station, by considering the representation of the petitioner dated 02.08.2021, on the file of first respondent herein in accordance with law to secure the ends of justice.

O R D E R

This Writ Petition is filed to direct the first respondent to remove the name of the petitioner in History Sheet H.S.No.374 of 2005 on the file of the Inspector of Police, Annamalai Nagar Police Station, by considering the representation of the petitioner dated 02.08.2021, on the file of first respondent herein in accordance with law to secure the ends of justice. 2.The learned counsel for the petitioner submits that the petitioner is an agriculturist and living humble life with his wife and children. One criminal case under Section 302 IPC was registered against the petitioner during the year 2014 on the https://hcservices.ecourts.gov.in/hcservices/

file of the second respondent herein the cases are false and however the second respondent without any basic material opened History Sheet No.374/2005 and the said History Sheet is continuing without review and without any purpose. Hence, expatiating the social boycott by members of public in his locality, he submitted a representation dated 02.08.2021 to the first respondent to remove the History Sheet No.374 of 2005 maintained by the second respondent. But till date no action was taken by the respondents. Hence, this Writ Petition is filed.

3.The learned Government Advocate (Crl.Side) appearing for the respondent Police would submit that the petitioner's representation dated 02.08.2021, has been received by the respondent police and within a period of eight weeks, the representation of the petitioner would be considered and thereafter, appropriate orders would be passed. 4.In view of the above, the respondent police are directed to consider the representation of the petitioner dated 02.08.2021, within a period of six weeks, from the date of receipt of a copy of this order and pass appropriate orders in accordance with law.
