PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the second respondent to consider and dispose petitioner's representation, dated 09.05.2025, requesting to rectify the measurement of petitioner's land in FMB Sketch comprised in Survey No.45/2, in Plot No.30, situate at Matharasanapalli Village, Enusonai Panchayat, Soolagiri Taluk, Krishnagiri District, admeasuring an extent of 3 cents, as per the allotment order, dated 25.07.1993, issued by the third respondent under the Special Scheme of Tamil Nadu Land Distribution (Poor & Landless Farmers) Special Plan,1998. For Petitioner : Mr.D.Ramesh Kumar For Respondents : Mr.A.Selvendran, Spl. Govt. Pleader.
ORDER
This Writ Petition is filed, praying for a mandamus to direct the the second respondent to consider and dispose of the petitioner's representation, dated 09.05.2025.
2. According to the petitioner, the subject land was allotted to his mother in terms of the allotment order, dated 25.07.1993, issued by the third respondent, under the Special Scheme of Tamil Nadu Land Distribution (Poor
& Landless Farmers) Special Plan, 1998, and after her demise, he has been in possession and enjoyment of the said property. However, Patta and FMB Sketch show a lesser extent. Therefore, he submitted a representation, dated 09.05.2025, before the second respondent, to rectify the extent of land in the revenue records.
3. Learned Special Government Pleader, appearing for the respondents, would submit that the representation submitted by the petitioner would be considered by the second respondent in accordance with law.
4. In view of the above, the second respondent is directed to consider the representation of the petitioner, dated 09.05.2025, and pass appropriate orders on merits and in accordance with law, after issuing notice to petitioner and other interested parties, if any, within a period of twelve weeks from the date of receipt of copy of this order.
5. Writ Petition stands disposed of accordingly. No costs. 29.07.2025 NCC :
