The petitioner, who was arrested and remanded to judicial custody on 20.09.2022 for the offences punishable under Sections 6, 24(i) of COTPA Act read with Sections 328, 353 and 506(i) of IPC in Crime No.444 of 2022 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner was in possession of 400 packets of banned tobacco products each weighing 10 gram. Hence, the case.
3. The learned counsel appearing for the petitioner would submit that he is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner.
4. The learned Government Advocate (Crl.side) appearing for the respondent would submit that the petitioner was in possession of 400 packets of banned tobacco products each weighing 10 gram. He would further submit that there are three previous cases of similar nature pending against the petitioner. Hence, he vehemently opposed to grant bail to the petitioner.
5. Taking into consideration the fact that the petitioner was arrested recently only on 20.09.2022 and he has got three previous cases of similar nature, this Court is not inclined to grant bail to the petitioner for the present. Hence, this Criminal Original Petition is dismissed. 29.09.2022 mpl
