PRAYER: Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus, to direct the respondents to produce the body or person of the petitioner's sister in law Mrs.Sarojini Segardoss, aged about 83 years, wife of Late Segardoss Augustin before this Court and set her at liberty.

ORDER
(Order of this Court was made by M.S.RAMESH.J,) Alleging that the petitioner's sister-in-law Mrs.Sarojini Segardoss, aged about 83 years is under the unlawful custody of the respondents 3 and 4 herein, this Habeas Corpus Petition has been filed.
2. Today, the alleged detenue Mrs.Sarojini Segardoss had appeared before us through video conferencing. On our interaction, she stated that she is now living in the residence of the respondents 3 and 4 under their care and protection. It is also her statement that she is residing there willingly without any coercion from the respondents 3 and 4 or any other person. Apart from appearing before us in-person, the detenue has also filed a duly sworn affidavit dated 13.08.2025, in which she has categorically averred that she is mentally sound and capable of making her own decisions and her decision to stay at Chennai was made by her consciously and voluntarily to escape the
abrasive control exercised by the petitioner and his family members over her life.
3. In view of the statement made by Mrs.Sarojini Segardoss, it cannot be stated to be a case of unlawful custody. Hence, the present prayer seeking for issuance of a Writ of Habeas Corpus does not deserve consideration.
