ORDER

This petition has been filed to direct the respondentPolice not to harass the petitioner and his family members.

2. No representation for the petitioner may be on account of boycott of Courts. However, in Harish Uppal [Ex.Capt.] Vs Union of India, reported in [2003] 2 SCC 45, the Hon'ble Supreme Court has held that boycott of Courts is illegal and therefore, this Court perused the records, heard the learned Additional Public Prosecutor and passed orders.

3. The learned Additional Public Prosecutor submitted that on a complaint given by one Mohammed Nizar Khan, petition enquiry in CSR.No.80 of 2016 is pending against the petitioner. Under such circumstances, blanket order of 'not https://hcservices.ecourts.gov.in/hcservices/

to harass' cannot be passed. The petitioner shall co-operate for the enquiry and during the course of enquiry, he shall not be harassed. However, if any cognizable offence is made out, this order would not be a shield against the arrest of the accused.

With the above observation, the Criminal Original Petition is disposed of.
