CMP No.10210 of 2017 in CMA (SR) No.44889 of 2017 R.MAHADEVAN, J.

This petition is filed by the petitioner / appellant / claimant seeking to condone the delay of 873 days in filing the above Appeal.

2. Heard both sides. The learned Standing Counsel for R-2/Insurance Company stated No objection in ordering this petition.

3. In view of the said submission, having regard to the reasons stated in the accompanying affidavit filed in support of this petition and being satisfied with the same, the delay of 873 days in filing the above Appeal is condoned subject to the following conditions:- (i) The petitioner / appellant shall pay a sum of Rs.500/- as cost to the "Tamil Nadu Legal Services Authority, Chennai"

on or before 30.09.2019; and (ii) The petitioner / appellant is not entitled to any interest for the default period, in the event of succeeding in the Appeal, in respect of the enhanced compensation amount.

4. This petition is ordered accordingly.
