ORDER

This criminal original petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 praying to direct the first respondent herein to register the complaint, dated 0510-2014. 2.

It is submitted that in the petition the petitioner as complainant has given a complaint in question on 05-10-2014 to the respondents and the same has not been registered. Under the said circumstances, the present petition has been filed for getting the relief sought therein.

Learned Additional Public Prosecutor has contended that on the basis of the complaint given by the petitioner, a preliminary enquiry has been conducted with regard to the allegations and after knowing well that the allegations mentioned therein are true, a case has been registered in Cr.No.5 of 2015 and now investigation is pending. https://hcservices.ecourts.gov.in/hcservices/

On the basis of the representation made on the side of the respondents, this Court has perused the concerned case diary, wherein it has been clearly stated that on the basis of the allegations mentioned in the complaint, preliminary enquiry has been conducted and after knowing the fact that sufficient materials are available so as to proceed further against the persons concerned, the case has been registered in Cr.No.5 of 15 and now the same is pending for investigation. 5.

Considering the aforesaid factual circumstances, the relief sought in the petition has become infructuous and therefore, the present petition is liable to be dismissed. In fine, this petition is dismissed.
