PRAYER: Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus, to direct the second respondent herein to produce the body of the petitioner's daughter, the detenue namely Lithiksha, D/o.Velmurugan, aged 5 years, before this Court and handover to the petitioner.

ORDER

(Order of this Court was made by M.S.RAMESH.J,) Claiming custody of the petitioner's minor daughter, aged 5 years, the Habeas Corpus Petition has been filed.

2. On the request of both the parties, we had referred the matter to Mediation and Conciliation Centre, Madras High Court. During the course of mediation, both the parties have amicably settled their dispute by arriving at the following terms:

"The petitioner and the 3rd respondent have mutually decided that they dissolve their marriage by way of mutual divorce. According on 19.07.2025, the petitioner and the 3rd respondent has filed mutual divorce application before the Sub-Court at tambaram in H.M.O.P S.r No.474/2025. Both of them have agreed to participate/appear till the final conclusion of the case.

The 3rd respondent shall have the custody of their daughter namely Lithiksha aged 5 years. The petitioner shall have visitation rights of her daughter on 1st Sunday of every month from 10.00 A.M to 5.00 P.M. On that day, the 3rd respondent or her family members shall bring the child to Villupuram town and handover to the petitioner. After the stipulated time, the petitioner shall return back the child to the 3rd respondent or her family members.

The petitioner and the 3rd respondent shall not cause any interference or disturbance to their respective personal life."

3. In view of the amicable settlement arrived, no further orders are required in this petition. Accordingly, the Habeas Corpus Petition stands closed by recording the terms of settlement dated 22.07.2025. [M.S.R., J] [V.L.N., J] 23.07.2025 Index: Yes/No Speaking/Non-speaking order Anu
