Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 2nd respondent not to harass the petitioner based on the false and bogus cases which were registered for statistical purpose.

This petition has been filed to direct the 2nd respondent not to harass the petitioner based on the false and bogus cases which were registered for statistical purpose.

2. The grievance of the petitioner is that the petitioner is running a tea shop and the respondent Police are unnecessarily harassing the petitioner on the guise of enquiry that the petitioner had been earlier arrested in two cases. The https://hcservices.ecourts.gov.in/hcservices/

petitioner was arrayed in two cases as though he has been selling Cigarettes and Tobacco products. Now on a regular basis, he has been called by the Police, which is affecting his business and livelihood.

3. The learned Additional Public Prosecutor submitted that the petitioner had involved in two cases in Crime No.2134 of 2021 for the offences under Sections 24(1), 294(b), 350(b) and 506(i) IPC and in Crime No.1936 of 2021 for the offence under Section 20(2) & 7(2) of Cigarettes and other Tobacco Products Act. For the purpose of enquiry he was called and one of the condition of the bail is that he shall appear before the respondent Police as and when called, which now cannot be termed as harassment. He further submitted that in both the cases enquiry is completed and the charge sheet is ready. The petitioner is no more needed for any enquiry.

4. Recording the same, this Criminal Original Petition is closed.
