O R D E R

The petitioner has come forward with this petition seeking for a direction to the third respondent to register a case pertaining to the petitioner's complaint dated 20.11.2015. 2.The learned counsel for the petitioner submitted that the petitioner has already filed a petition in Crl.O.P.No.897 of 2016 for the above stated relief, wherein it was stated that already the matter has been enquired and closed. On the basis of the closure report, Crl.O.P.No.897 of 2016 was closed and the petitioner was given liberty to work out his remedy in the manner known to law. He further submitted that the petitioner has filed the present petition for the same relief because the petitioner entered into a sale agreement with the counter petitioners and they received Rs.13,50,000/- from the petitioner. On enquiry, it came to know that the property https://hcservices.ecourts.gov.in/hcservices/

stands in the name of some other person and even then, they have not returned the amount. But without considering the same, closure report has been passed. Hence, the petitioner has come forward with this petition for the above stated relief. 3.Heard the learned Additional Public Prosecutor appearing for the respondents.

4.Considering the submission made by the learned counsel for the petitioner and on perusal of the closure report, it was specifically mentioned that the property stands in the name of the persons who entered sale agreement with the petitioner i.e., Nachammal, Ramal, Jayanthi and Perumal.

Further, in Crl.O.P.No.897 of 2016, liberty has been given to the petitioner to workout his remedy in the manner known to law. In such circumstances, I am of the view the petitioner is not entitled to re-agitate the matter before this Court once the order has been passed.

5. The Criminal Original Petition is disposed of with the above observation.
