Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st and 2nd respondents to constitute a special team to enquire into and investigate the affairs of the 5th respondent society in respect of the sanction of crop loans, extending the benefits of the loan waiver scheme announced by the Government of Tamilnadu vide G.O.(Ms)No.50 dated 23.05.2016 and G.O.(Ms)No.59 dated 28.06.2016 both issued by the 1st respondent and consequently take appropriate actions, including actions under the provisions of the Tamilnadu cooperatives societies act against the erring officials of the 5th respondent society. O R D E R

The petitioner is stated to have passed away. However, nothing survives in this writ petition for the following reasons: (i) The prayer of the petitioner is for a direction to the first and second respondents i.e. the State of Tamilnadu represented by Secretary to Government, Cooperation, Food and Consumer Protection Department/R1 and Registrar of Cooperative Societies/R2 to enquire into an investigate the affairs

of the 5th respondent Society i.e. I.I.624, Pankaram Primary Agricultural Cooperative Bank Limited in respect of sanction of crop loans and extending of the benefits under loan waiver scheme announced under G.O.(Ms).No.50 dated 23.05.2016 and G.O.(Ms).No.59 dated 26.06.2016. (ii) Pending writ petition, on 15.03.2017, this Court noted an interim direction in another writ petition granted on 18.11.2016, directing the first respondent to consider and order a State wide enquiry into malpractices, if any, in Co-operative Societies.

(iii) In consequence of the same, a committee appears to have been constituted and under proceedings in Na.Ka.2108/2016 dated 21.03.2017, they have come to the conclusion that there are no such malpractices. A copy of the report is placed on file and one supplied to the learned counsel who is on record for the petitioner as well.

2. With this, the object of the writ petition stands achieved. Recording this, this writ petition is closed. No costs. Connected miscellaneous petition is also closed.
