Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus to direct the respondent to pay the petitioner the difference/arrears of wages for the period from 01.09.2013 to 31.01.2015 and also terminal benefits namely Gratuity and Encashment of Leave, after revising the same based on the scale of pay payable to him from 01.09.2013 as admitted by the respondent in the RTI information dated 22.11.2024 together with 18% interest per annum, within a time frame as may be fixed by this Court.

ORDER

The present wit petition has been filed with a prayer for Mandamus, to direct the respondent to pay the petitioner the difference/arrears of wages for the period from 01.09.2013 to 31.01.2015 and also terminal benefits namely Gratuity and Encashment of Leave, after revising the same based on the scale of pay payable to him from 01.09.2013 as admitted by the respondent in the RTI information dated 22.11.2024 together with 18% interest per annum, within a stipulated time.

2. The case of the petitioner is that he joined in the 1st respondent Corporation on 02.07.1979 and had retired from his service on 31.01.2015. It is the grievance of the petitioner that though he was paid retirement benefits by virtue of 14th Wage settlement the petitioner is eligible to receive certain amount from the respondents. In this connection, the petitioner has sent a representation on 10.06.2025 to the respondent and such representation is pending for consideration on the file of the respondent.

3. At this juncture, the learned Standing Counsel appearing on behalf of the respondent would fairly submit that he will consider the above said 2/4

representation of the petitioner and pass orders within a reasonable time.

4. Heard the learned counsel on either sides and perused the materials available on record.

5. In view of the said fair submission made by the learned Standing Counsel for the respondent, without going to the merits of this Writ Petition, this Court deems it appropriate to direct the respondent to consider the petitioner's above representation dated 10.06.2025 and pass orders according to its own merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.

6. With the above observations, the Writ Petition stands disposed of. No costs.
