ORDER

This criminal original petition is filed to quash the proceedings in C.C.No.644 of 2015, on the file of learned XV Metropolitan Magistrate at George Town.

2. When the matter was taken up for hearing, the learned counsel appearing for the petitioner, after arguing for a while, sought permission of this court to withdraw this petition, with liberty to file a discharge petition to raise all his legal grounds before the trial court. At this stage, he also seeks the indulgence of this court, to dispense with the personal appearance of the petitioners/accused before the trial Court.

Accordingly, this petition is dismissed as withdrawn with liberty to file a discharge petition to raise all his legal grounds before the trial Court and having regard to the nature of the complaint filed, the personal appearance of the petitioners/accused before the trial Court, is dispensed with, except for receipt of copies, answering the charges, questioning under Section 313 Cr.P.C., or on any other date as may be required by the trial Court. Consequently, the connected criminal miscellaneous petitions are closed.
