ORDER
The present writ petition has been filed with a prayer for Mandamus, to direct the respondents 1 & 2 to consider the petitioner's representation dated 16.05.2025.
2. The primary contention raised by the learned counsel for the petitioner is that the 3rd respondent has entered into a Lease Agreement in respect of the petitioner's property. It is the contention of the petitioner that the property was purchased by his father in the year 1973, and subsequently, he died during the year 2000. It is further contended that during his father's lifetime, the petitioner's mother executed a 30-year lease agreement with the 3rd respondent, claiming that the petitioner was a minor at that point of time. However, the petitioner contends that he was, in fact, a major when the lease was executed. In this regard, he submitted a representation dated 16.05.2025 to the 1st and 2nd respondents, requesting them to examine the 2/6
authenticity and validity of the relevant documents.

At this juncture, the learned Additional Government Pleader and the learned learned Special Government Pleader appearing for the respondents 1 and 2 vehemently contended that the issue raised in the present writ petition is civil in nature and therefore, the petitioner is not entitled to seek any remedy before this Court.

The learned Additional Government Pleader also invited the attention of this Court to the fact that a civil suit is pending between the petitioner and the 3rd respondent before the District Munsif-cum-Judicial Magistrate, Mayiladuthurai, in O.S.No.50 of 2024 and the case stands posted for hearing on 08.09.2025.
5. I have given my anxious consideration to either side submissions and also perused the materials available on record.
6. From the submissions made by the learned Additional Government Pleader, it is evident that a civil dispute pending between the petitioner and 3/6
the 3rd respondent. In such circumstances, when similar issues are already the subject matter of a civil suit, entertaining a writ petition on the same grounds is neither appropriate nor permissible. Moreover, any disputed questions of fact are best adjudicated by the competent civil Court. Therefore, this Court does not find any merits in the present writ petition and accordingly, the same is liable to be dismissed.
7. In the result, the writ petition stands dismissed. No costs. 29.07.2025 ssi Index : Yes Speaking Order : Yes /No 4/6
