The petitioner has filed this petition seeking direction to the second respondent to survey and measure the property as per mets and bounds based on the petitioner representation dated 20.12.2019 and 06.09.2022 situated at Chennai North, Sembiam Sub Registrar Office within Chennai Corporation Limit, Kolathur Village, Bymas No.754, Survey No.7/1, T.S.No.153, 152, 110, 109, 100, 92, 95, 96, 97, 98 & 99 Block No.2 with and extent of 59 cents (25700 Sq.ft) pending before the 1st and 2nd respondent.
2. By consent of both the parties, this writ petition is taken up for disposal at the stage of admission itself.
3. The case of the petitioner is that the schedule property comprised in S.No.7/1 of Punja Land to an extent of 59 cents at Kolathur Village, Chennai is a petitioner's ancestral property. Being the only male legal heir, the said property was taken possession and enjoyed by the petitioner after the demise Page No.2 of 6
of his parents. This being the case, two other persons viz., Padmanaban and Gangadharan @ Ganga Reddy, who are no way connected to the subject property made an attempt to trespass into the property and threatened the petitioner. In order to protect the said property from the aforesaid two persons, the petitioner made a representation dated 06.09.2022 before the first respondent to measure the subject property, however, till date, no action was taken. Hence, this writ petition.
4. Though very many grounds have been raised in this Writ Petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the second respondent to consider the petitioner's representation dated 06.09.2022 and pass orders on merits within a particular time frame to be fixed by this Court.
5. The learned Additional Government Pleader appearing for the respondents has no objection for said order being passed.
6. Heard the learned counsel on either side and perused the materials Page No.3 of 6
placed on record.
7. Taking into consideration the factual aspects of the matter, this Court without going into the merits of the case, directs the second respondent to consider the petitioner's representation dated 06.09.2022 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
8. With the above observation and direction, this Writ Petition is disposed of. No costs.
