(II)To dispense with the Production of the copy list of registration Number of candidates selected provisionally for appointment dated 20.8.19 issue by the Third Respondent along with the Present Writ petition IN WMP.NO.25703 OF 2019 AND; (III) To grant an Interim Injunction restraining the Respondents 1 to 3 to issue any order of Appointment to any of the selected Candidates in Pursuance of the select List dated 20.8.19 (IN WMP.NO.25705 OF 2019) pending disposal of this Writ Petition.NO.26349 OF 2019 Respectively.
Order : These petitions coming on for orders upon perusing the petitions and the respective affidavits filed in support thereof and upon hearing the arguments of M.RAVI, Advocate for the petitioner and of MRS.NARMADH SAMPATH, ADDITIONAL ADVOCATE GENERAL FOR MR.M.ELUMALAI, GOVERNMENT on behalf of the Respondents the court made the following order:- The case of the petitioner is that the petitioner participate the selection process for the post of Forest Apprentice, in that notification the physical qualification is fixed as if in respect of men height is 163 cms and chest measurement on full expansion 84 cms, on full inspiration 89 cms and the difference is 5 cms, in respect of women height is 150 cms and chest measurement on full expansion 79 cms and chest measurement on full expansion 84 cms, on full inspiration 84 cms and the difference is 5 cms. The main
allegation of the petitioner as the private respondents they are not qualified the physical measurement, however they are selected. 2.Considering the prima facie case, I am inclined to appoint the Dean Madras Medical College and he is requested to take a physical measurement of the Private respondents namely B.C.Rumya, A.P.M.Kanimozhiarasu, R.Sasikumar, K.Murugan, M.Jananie, G.Sandhiya, S.Suresh, D.Raja on 04.11.2019 and file a report before this Court on 08.11.2019 and the petitioner is directed to deposit a sum of Rs.5000/- (Rupees Five Thousand only) each totally Rs.40,000/- (Rupees Forty Thousand only) to the Dean for the welfare of Madras Medical College. The said amount may be utilised for the welfare of Medical College. The learned Additional Advocate General takes Notice.
3.Post the Writ Petition on 08.11.2019.
