ORDER
This Criminal Original Petition has been filed to direct the first respondent to withdraw the First Information Report in Crime No.32 of 2024, from the file of the second respondent and to transfer the investigation to the file of the third respondent and further direct the third respondent to file the final report, within a specific time frame as fixed by this Court.
2. The petitioner, as a Managing Trustee of the temple, has preferred a complaint for fraudulent transaction orchestrated to unlawfully alienate the
temple property and based on the complaint, a case has been registered in Crime No.32 of 2024 for the offences under sections 420, 468, 471 and 120B of IPC. The petitioner seeks transfer of investigation mainly on the ground that the investigation has not been proceeded. It is the case of the petitioner that the accused had committed an act of forgery and sold the temple property. Though the First Information Report has been registered on 12.06.2024, no progress has been made.
3. Whereas, the learned Government Advocate [Criminal Side] would submit that the investigation has been completed and draft final report has been prepared and final report will be filed before the concerned Court, within a month.
4. In such view of the matter, this Court is of the view that as the entire issue has to be unearthed only on the basis of the materials which have already been collected and the investigation has already been completed and only final
report has to be filed, no transfer of investigation is required at this stage. Let the respondent file the final report expeditiously, without any further delay.
