ORDER
This writ petition has been filed for issuance of writ of mandamus directing the respondents 1 and 2 to consider petitioner's representation dated 25.06.2025 and conduct an enquiry, initiate an appropriate action against the erring officials in the Fisheries and Fishermen Welfare Department, Government of Tamil Nadu and others and consequently direct the respondents to register the case.
2. The petitioner had sent a complaint to the respondents 1 and 2 on 25.06.2025. The crux of the complaint is that the officials and Engineers of the Fisheries and Fishermen Welfare Department in connivance with contractors and others had caused wrongful loss to the exchequer of the Government of Tamil Nadu to the tune of more than Rs.1,000/- crores by manipulating the tender process and violating provisions of the Tamil Nadu Tender Transparency Act, 1998.

According to the petitioner, there have been irregularities in estimate preparation, violation of departmental data and rates in construction of Fish Landing Centre at Kesavan Puthenthurai Village and Kottilpadu in Kanniyakumari District, providing additional infrastructure facilities, forwarding and backwarding linkages to the Thengapattinam Fishing Harbour in Kanniyakumari District, construction of shore facilities in Mallipattinam at Thanjavur District, likewise in various parts of State of Tamil Nadu. The petitioner claims that he is the senior Civil Engineering Contractor for Government works with 40 years of experience in the construction of Fish Landing Centres and Fishing harbours and he has completed various tender works related to these projects for the Government of Tamil Nadu. Out of his experience and knowledge of tender process, he could find out the said malpractices committed by the officials of PWD and Fisheries in execution of the projects.

The learned Additional Public Prosecutor appearing for the respondents submitted that the petitioner's complaint was received and on 30.07.2025, the second respondent had addressed a confidential communication to the Additional Chief Secretary, Vigilance Commissioner and Commissioner for Administrative Reforms, Secretariat, Chennai, seeking permission under Section 17(A)(1) of the Prevention of Corruption (Amendment) Act, 2018 and also reminded that the concerned authority shall convey its decision within a period of three months and the same to be communicated by writing by such authority.
