(Order of this Court was made by the Hon'ble Acting Chief Justice) This WMP. has been filed seeking to re-open the order dated 18.08.2022 made in W.P.No.21287/2022 by this Court in and by which while recording the pre-notice dated 29.07.2022 issued to the violators/respondents 4 to 6 observed that the authorities will proceed further after verification of the approved plan, if any, submitted by the respondents 4 to 6 and take further action, if they find any violation of the conditions with which the plan was approved, against the violators, as per law, in respect of the property-inquestion and liberty was also given to the petitioner to re-open the matter, if there is any grievance. Pursuant to the same, when this WMP. was filed, this Court by an order dated 01.11.2022 directed the 2nd respondent to appear before this Court on the next hearing date i.e. on 29.11.2022 to explain why action has not been taken against the violators/respondents 4 to 6 in compliance with the direction of this Court.

Learned Standing Counsel appearing for the Corporation of Chennai now submitted that after the issuance of the notice dated 15.10.2022 giving 30 days time calling upon the violators to revert the property-in-question to its original condition before the said construction took place, De-occupation notice dated 18.11.2022 has also been issued, therefore, they have taken action as per the direction of this Court. He further submitted that today, they have also taken further action by locking and sealing of the property-inquestion. 3.

In view of the above developments shown by the 2nd respondent, we are of the view that no further orders are required in this petition. Needless to mention that if there is any legal hurdles for further action, the petitioner can very well approach this Court, if she is so advised.

The WMP. is ordered accordingly.
