This petition has been filed seeking to grant Special Leave to the petitioner to file criminal appeal against the order dated 27.04.2023 passed in C.C.No.2791 of 2013 by the learned Metropolitan Magistrate, FTC - III, Saidapet, Chennai.

2.The learned counsel for the petitioner would submit that without giving any opportunity to the petitioner, the case was dismissed under Section 256 of Cr.P.C. which is not sustainable one. 3.Having regard to the submissions made by the learned counsel for the petitioner and being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is ordered. Leave granted.
