ORDER

The petitioner has filed this petition to set aside the Judgment passed by the learned Judicial Magistrate Sulur, Coimbatore District, in C.C.No.43 of 2018 dated 07.03.2023 as confirmed by the Judgment of the III Additional District and Sessions Judge, Coimbatore in C.A.No.80 of 2023 dated 26.06.2025.

2. The learned counsel for the petitioner and learned counsel for the respondents appeared and perused the materials available on records.

3. As per the directions given by the Apex Court in Special Leave to Appeal (Crl.) No.13010 of 2025, petitioner has complied with the conditions by depositing the cheque amount.

4. The learned counsel for the petitioner submitted that the petitioner has deposited the entire cheque amount as per the Apex Court's directions dated 28.08.2025. In accordance with the directions of the Apex Court, the amount was deposited on five occasions, totalling Rs. 45,71,320/-. In support, he

produced the receipts granted by the learned Judicial Magistrate, Sulur, dated 09.09.2025, 23.09.2025, 08.10.2025 & 07.11.2025.

5. As on date, the petitioner has complied with the conditions imposed by the Hon'ble Supreme Court and the entire cheque amount has been paid. Therefore, keeping the case alive does not serve any purpose and the matter does not require any further proceedings. The issues between the parties are thus settled, and the petitioner / accused is ordered to be acquitted in C.C. No. 43 of 2018.
