The fist respondent in the appeal suit died. These petitions have been filed (i) to condone the delay of 1566 days in bringing the legal representatives of the deceased first respondent (ii) to set aside the abatement due to the death of the deceased first respondent and (iii) to bring on record the proposed respondents 3 to 9 as the legal representatives of the deceased first respondent.

2. The learned counsel for the second respondent is present and has no objection in allowing these petitions.

3. Perused the affidavit filed in support of these petitions and satisfied with the reasons stated therein, these Civil Miscellaneous Petitions are ordered.

4. Registry is directed to carry out the necessary amendments and list the matter on 20.12.2023.
