Prayer: Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure to withdraw the petition in H.M.O.P No.128 of 2021 on the file of Subordinate Court, Gobichettipalayam and transfer the same to the Family Court, Thanjavur.

ORDER

The above Transfer Civil Miscellaneous Petition has been filed by the wife seeking transfer of H.M.O.P No.128 of 2021, filed by the husband seeking divorce, pending on the file of the Subordinate Court, Gobichettipalayam, to the file of the Family Court, Thanjavur.

2. The petitioner/wife would submit that the distance between her residence and the Subordinate Court, Gobichettipalayam, is nearly about 560 kms. Further, the petitioner is not in a position to travel all the way to Gobichettipalayam to attend all the hearings. It is also stated that she is not receiving any maintenance from the respondent/husband.

Considering the reasons given by the wife and also taking into account the fact that the wife is residing within the jurisdiction of the Family Court, Thanjavur, the above petition is allowed, accordingly, H.M.O.P.No.128 of 2021, pending on the file of the Subordinate Court, Gobichettipalayam, is transferred to the file of the Family Court, Thanjavur.
