[Order of the Court was made by V.SIVAGNANAM, J.] This Court in W.M.P.No.11938 of 2024 in W.P.No.12860 of 2020 has granted extension of leave to the petitioner's husband for a period of 3 months i.e., from 05.06.2024 to 18.09.2024.
2. The present miscellaneous petition is filed for extension of leave for a further period of 3 months i.e. from 18.09.2024 to 17.12.2024.
3. Learned counsel for the petitioner submitted that the petitioner is eligible for premature release in the year 2018 as per G.O.Ms.No.64 of 2018. Therefore, the petitioner had already filed a petition seeking extension of interim bail and this Court extended the interim bail for further period of three months, which expires on 18.09.2024.
4. The learned Additional Public Prosecutor appearing on behalf of
the respondents would submit that the premature release process is still at the same stage and further orders have not been passed so far and learned Additional Public Prosecutor has produced a report of Probation Officer, which recommends to grant extension of leave to the petitioner's husband.
5. In view of the above facts and also taking note of the fact that the interim bail expiries on 18.09.2024, we are inclined to extend the interim bail for further period of three months (3) months on the same conditions as imposed in W.M.P.No.29638 of 2023 in W.P.No.12860 of 2020.
6. Accordingly, this Miscellaneous Petition stands allowed. The interim bail is hereby extended for a further period of three (3) months from 18.06.2024 till 17.12.2024.
